This Privacy Policy explains how our Practice collects, holds, uses and discloses personal information, including health information, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), and applicable health records legislation.  By providing us with your personal information, or continuing to engage our services, you consent to the collection, use and disclosure of that information as described in this policy.

2. The Kinds of Personal Information We Collect and Hold

In the course of providing chiropractic care, we may collect and hold the following types of personal information:

  • Identifying details — name, date of birth, gender, partnership status, address, phone number, email address, and emergency contact details.
  • Health information — medical and treatment history, presenting complaints, examination and assessment findings, imaging and diagnostic results, treatment notes, progress records, and information about medications, allergies, or other health conditions relevant to your care.
  • Billing and payment details — Medicare, private health insurance, and payment or banking details required to process accounts.
  • Referral and correspondence information — details from referring practitioners, specialists, or other allied health providers.
  • Website and appointment booking information — where applicable, information submitted through our website

3. How We Collect Personal Information and Where It Is Stored

Wherever practicable, we collect personal information directly from you, including:

  • New patient intake and consent forms completed in person or online.
  • Consultations, examinations, and treatment sessions.
  • Phone, email, or online correspondence, including appointment bookings.

In some circumstances we may collect information from a third party, such as a referring GP, specialist, allied health provider, employer (for workers’ compensation claims), image providers, insurer, or a family member acting on your behalf, where it is unreasonable or impractical to collect it from you directly.

Your personal information may be stored in electronic records, archived paper records and diagnostic imaging records.

Dynamic Neurodevelopment uses VisitBase clinical software to securely store patient information. Electronic records are protected through password-controlled access systems, encryption and other security measures designed to prevent unauthorised access, misuse, loss, alteration or disclosure.

Patient information may be stored using secure cloud-based services located within Australia. Electronic data is stored in Australian-based data centres and protected through:

  • Encryption of data both in transit and at rest.
  • Role-based access controls and user authentication.
  • Device specific security measures.
  • Password-protected systems.
  • Secure backup and disaster recovery processes.
  • Regular software updates and security monitoring.

Paper records and hard-copy documents are stored in secure areas that are not accessible to the public.

We maintain internal policies and procedures regarding the collection, storage, access and management of personal information and regularly review our information security practices.

4. Why We Collect, Hold, and Use Personal Information

We collect, hold, and use personal information for the following purposes:

  • To assess your health needs and provide chiropractic diagnosis, treatment, and ongoing care.
  • To maintain accurate clinical records
  • To communicate with you about appointments, reminders, treatment plans, and follow-up care.
  • To process accounts, claims, and payments, including Medicare and private health fund claims where applicable.
  • To liaise with other treating practitioners involved in your care, with your consent where required.
  • To meet our legal, regulatory, professional, and insurance obligations.
  • To manage and improve our practice, including staff training, quality assurance, and clinical audits.
  • For direct communication purposes, such as newsletters or health promotions, only where you have not opted out and in accordance with the APPs.

5. How We Use and Disclose Personal Information

We only use or disclose personal information for the purpose it was collected, a directly related secondary purpose you would reasonably expect, or as otherwise permitted or required by law, or with your consent. We may disclose information to:

  • Other healthcare providers involved in your treatment (e.g. GPs, specialists, dentists, occupational therapists, physiotherapists, radiologists etc).
  • Medicare, private health insurers, and workers’ compensation or third-party insurers, where relevant to a claim.
  • Our administrative, billing, IT, and practice management service providers, who are bound by confidentiality obligations.
  • Regulatory bodies, professional associations, or courts, where required or authorised by law.
  • Other than in the course of providing chiropractic care, or as otherwise outlined in this policy, we will not disclose your personal information to third parties without your consent. An exception may apply where selected third-party service providers assist us in operating our practice and maintaining patient communications, such as appointment reminder services. (eg Kajabi website platform, Visitbase )
  • We will not rent or sell your personal information or disclose it to unrelated third parties for their own marketing purposes.

 

6. Disclosure of Information Overseas

We do not routinely disclose personal information to overseas recipients. Where we use cloud-based practice management or storage providers that may store or process data outside Australia, this may include servers located in the United States or other countries, we take reasonable steps to ensure any overseas recipients handle your information in a manner consistent with the Australian Privacy Principles.

7. Access to and Correction of Your Personal Information

You may request access to the personal information we hold about you or ask us to correct information you believe is inaccurate, or incomplete. Requests should be made in writing to our Practice Manager using the contact details above. We will respond within a reasonable timeframe, generally within 30 days, and in accordance with applicable privacy laws.

8. Privacy Concerns

If you believe we have breached the Australian Privacy Principles or mishandled your personal information, please contact our Office Manager using the details above, providing as much detail as possible. We will acknowledge your complaint promptly and investigate it, generally responding within 30 days.

9. Data Security, Retention, and Destruction

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, or disclosure. These steps include secure electronic systems with password protection and encryption, restricted staff access on a need-to-know basis, locked physical storage, and staff training on privacy obligations.

We retain health records for the period required by applicable law. When personal information is no longer required for the purpose for which it was collected and we are not required by law to retain it, we will take reasonable steps to securely destroy or permanently de-identify it, such as secure shredding of paper records and secure deletion of electronic records.

10. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal obligations. The most current version is available at reception and on our website.
